DEPOSIT AGREEMENT/CONTRACT

DEPOSITS ARE NON-REFUNDABLE
A Deposit is required to hold a puppy of your choice. The deposit price
is $200.00 and is NOT REFUNDABLE unless something happens to your puppy while in our care. Once a puppy is chosen, the deposit
cannot be transfered to another puppy.
Final payment must be made when puppy is 10 weeks old to allow time for vet exams
and shipping. If the puppy is over 10 weeks of age, then payment in full must be paid within 1 week of deposit being received.
If the puppy is not shipped or picked up by the due date, the breeder reserves the right to resell the puppy and deposit
will be forfeited.
Puppies are usually priced at 4 to 6 weeks of age but cannot be shipped until 10 to 12 weeks of age
(NO EXCEPTIONS). Extra small puppies will need to stay with us a while longer.
All sales are subject to a check from
your Veterinarian. You have 72 hours to complete this. If a health problem is found, your money plus the deposit will then
be refunded upon return of the puppy. Registration papers and all medical history; shot records, wormings, vet findings must
be returned to me.
HEALTH GUARANTEE/CONTRACT
TERMS AND CONDITIONS
The breeder certifies that this puppy has been examined by a licensed veterinarian and is in good
health. A shot record indicating what vaccinations and wormings were administered to the puppy will be supplied. The seller
does not warranty the puppy against any adverse reactions to future vaccines.
The seller guarantees against the following
infections for a period of 1 week - parvo,
distemper, rabies. No other infectious diseases or viruses are covered. It
is up to the buyer to keep up with vaccines and have puppy checked regularly for infectious diseases or viruses. All of these
are totally preventable with proper care.
The seller is not responsible for the associated charges, such as shipping
or vet fees, stress or hypoglycemia. The seller is not responsible for hospital stays due to airplane stress. If the purchaser
is buying an extra tiny, it is highly recommended that the puppy be picked up.
Loose stools or coccidia can be caused
by stress and can develop within hours into transport. This guarantee does not cover internal or external parasites, coccidiosis,
giardia, hepatitis, mites, worms, kennel cough, overshot or undershot jaws.
This guarantee does not cover injuries caused
by a fall or because the puppy was physically harmed in any way.
This guarantee does not cover the following minor flaws
or any condition that is minor and can be corrected by veterinarian intervenion: Open frontanel (molera), size as adults,
collapse of the tracheal rings, hernias of any kind, testicals not descending, patella luxation.
This puppy is not guaranteed
for breeding or show ability. Seller has no control over these things as too many variables are involved.
The seller
is not responsible for death, injury or loss of puppy during transportation. The purchaser will need to settle this with the
airlines. Once you sign for the puppy, you will have released the airlines of any wrong doing.
The seller is not responsible
for death or illness due to hypoglycemia. It is the responsibility of the buyer to ensure proper nutrition and care of the
new puppy.
This puppy is NOT TO BE PLACED in an animal shelter of any kind, but returned to the seller at no cost to
the seller with all registration papers and vet records if you cannot keep or find it a good home. Before seller receives
dog back, seller has the right to conduct DNA testing to prove dog is of Tgarden Pets parentage.
For protection of both
parties; the buyer and the seller, we require that the puppy be examined by a licensed veterinarian within 72 hours (starts
at shipping). It is a good idea to line up an appointment before the puppy is shipped. If the puppy is not examined by a licensed
vet within 72 hours of shipping, This contract is then NULL AND VOID.
If the puppy is declared to be in unacceptable
health by a licensed vet within 72 hours of the shipping date, and is returned within 1 week of shipping with a written statement
of the vet's findings under his letterhead, then, at the seller's option, we will replace the puppy with one of EQUAL
value or refund the purchase price. Veterinarian's phone number and address must be included in the letterhead and ALL
colors/markings and sex of puppy must be noted in vet's statement.
This puppy is guaranteed against LIFE THREATENING
genetic defects for 1 year. If this puppy is diagnosed with a life threatening gentic defect within the first year of life,
we will replace the puppy with one of equal value or refund purchase price. Under no circumstance will the seller be responsible
for any vet bill, boarding and/or any treatment decided upon by the buyer, even if the puppy is returned.
Chihuahuas
are very small and fragile dogs and death can result from a simple fall or being stepped on. There will be NO REFUNDS OF ANY
KIND for injuries and/or death caused by trauma and/or neglect. It is the buyer's responsibility to make sure the puppy
is always in a safe environment. In the event of death of the puppy, purchaser will need to furnish seller with an autopsy
from a licensed Vet as proof of the cause of death. Address and phone number must be included in vet's letterhead for
verification as well as puppy's colors, markings and sex.
Chihuahuas are indoor dogs and must be provided shelter
from the elements. This puppy must not be kept outdoors at all times and be provided shelter from rain, heat, snow, etc.....
Furthermore, this puppy MUST NOT BE KEPT in a backyard breeder environment. Any breach of this contract will result in puppy
being returned to seller and no compensation will be given to the buyer.
I have read, understand, agree and acknowledge
receipt of a copy of the above terms and conditions. By signing below, I agree to all terms and conditions of this contract
and any legal action which may arise under the terms of this contract will be brought up in Greeneville, Tennessee.
